1.1.2 Primary Regulatory Authority: As an Abu Dhabi-headquartered entity, Address Point Properties is primarily regulated by and subject to the oversight of the Abu Dhabi Department of Municipalities and Transport (DMT), including compliance with DMT real estate brokerage regulations, licensing requirements, marketing guidelines, and consumer protection standards. The Company maintains all requisite Abu Dhabi trade licenses, brokerage permits, and regulatory approvals necessary for UAE-wide operations.
1.1.3 UAE-Wide Service Authorization: Pursuant to UAE Federal law, inter-emirate cooperation frameworks, and applicable regulatory provisions, Address Point Properties is authorized under UAE Federal law and applicable inter-emirate cooperation frameworks to market, broker, and facilitate real estate transactions for properties located in any Emirate of the UAE, subject to compliance with the local regulatory requirements of the Emirate where each specific property is situated.
1.1.4 Federal Law Supremacy: Notwithstanding Emirate-specific regulatory frameworks, all operations of Address Point Properties are subject to and governed by the Federal Laws of the United Arab Emirates, which take precedence in matters of nationwide application including data protection, telemarketing, cybercrime, commercial transactions, consumer protection, and artificial intelligence regulation.
1.2 Purpose and Comprehensive Legal Framework
These Terms establish the exhaustive legal framework governing your access to, use of, and interaction with Address Point Properties’ digital platforms (including but not limited to our website www.approperties.ae, mobile applications, client portals, and associated web properties), marketing communications, artificial intelligence systems, real estate brokerage services, advisory services, events, competitions, promotions, and all other offerings across the United Arab Emirates.
These Terms are meticulously drafted to ensure comprehensive compliance with the following UAE legislation, regulatory frameworks, and legal principles:
- Federal Constitutional Framework: UAE Constitution (1971, as amended), Federal Supreme Court precedents, and principles of UAE civil law;
- Data Protection: Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (“UAE PDPL”) and Executive Regulations (Cabinet Resolution No. 57 of 2024);
- Telemarketing: Cabinet Resolution No. 56 of 2024 concerning the Regulation of Telemarketing Activities and Federal Do Not Call Registry (DNCR);
- Cybersecurity & Electronic Transactions: Federal Decree-Law No. 34 of 2021 on Combating Rumours and Cybercrimes; Federal Law No. 1 of 2006 on Electronic Commerce and Transactions;
- Artificial Intelligence: Federal Decree-Law No. 47 of 2021 on the Regulation of the Use of Artificial Intelligence and Advanced Technologies; UAE AI Ethics Principles;
- Commercial Law: Federal Law No. 32 of 2021 on Commercial Transactions Law; Federal Law No. 19 of 2018 on Foreign Direct Investment;
- Consumer Protection: Federal Law No. 15 of 2020 on Consumer Protection; relevant ministerial resolutions and guidelines;
- Anti-Money Laundering: Federal Decree-Law No. 20 of 2018 on Anti-Money Laundering and Combating the Financing of Terrorism; Cabinet Resolution No. 10 of 2019;
- Taxation: Federal Decree-Law No. 47 of 2022 on Corporate Tax; Federal Decree-Law No. 8 of 2017 on Value Added Tax;

- Emirate-Specific Compliance: Where marketing or brokering properties in other Emirates (e.g., Dubai, Sharjah), compliance with local regulatory requirements of the property’s location Emirate, while maintaining Abu Dhabi as the Company’s primary regulatory jurisdiction;
- International Obligations: UAE’s international treaty obligations, including WIPO conventions, GDPR adequacy considerations for cross-border data transfers, and other applicable international frameworks.
1.3 Exhaustive Definitions and Rules of Interpretation
In these Terms, unless the context expressly requires otherwise, the following terms shall have the meanings ascribed to them below. These definitions are exhaustive and intended to eliminate ambiguity:

“Expression of Interest” | A legally defined, exhaustive, and irrevocable action (detailed in Section 4) that demonstrates a User’s intent, inquiry, engagement, or interest regarding real estate offerings, services, information, or opportunities from Address Point Properties, thereby triggering permissible follow-up communications, data processing, and service delivery under UAE telemarketing regulations, PDPL, and contractual principles. An Expression of Interest constitutes explicit consent for specified processing activities. |
“Marketing Communications” | Any promotional, informational, engagement-focused, transactional, or service-related message disseminated by or on behalf of Address Point Properties via any channel, medium, format, technology, or platform, whether current or future, including but not limited to: website content, email campaigns, SMS/MMS, WhatsApp Business messages, social media posts/reels/stories/videos/ads (Meta, Google, TikTok, LinkedIn, X, Snapchat, Pinterest, etc.), digital display advertising, programmatic advertising, native advertising, influencer collaborations, print media, radio broadcasts, television commercials, outdoor advertising (billboards, transit ads, digital screens), events, exhibitions, webinars, in-person signups, QR code engagements, voice assistants, smart device integrations, augmented/virtual reality experiences, and any emerging digital, analog, or hybrid media channels. |
“Personal Data” | Any information relating to an identified or identifiable natural person (“Data Subject”), as defined in Article 1 of UAE PDPL and interpreted expansively under UAE law, including but not limited to: name, identification numbers (Emirates ID, passport, visa), location data, online identifiers (IP address, device IDs, cookies), contact details, financial information, transaction history, interaction records, call recordings, biometric data (where applicable), behavioral data, preferences, opinions, inferences, profiles, and any other data that can directly or indirectly identify an individual, whether standing alone or combined with other information. |
“Do Not Call Registry (DNCR)” | The federal registry established under Cabinet Resolution No. 56 of 2024, managed by the Telecommunications and Digital Government Regulatory Authority (TDRA), containing telephone numbers of individuals who have opted out of receiving unsolicited telemarketing communications, subject to exemptions for explicit consent, existing customer relationships, and other lawful bases. |
“Relevant Authority” | Collectively refers to: (a) Abu Dhabi Department of Municipalities and Transport (DMT) as the Company’s primary regulator; (b) Dubai Land Department (DLD) and Real Estate Regulatory Agency (RERA) for Dubai property-related matters; (c) regulatory authorities of other Emirates (Sharjah, Ajman, Umm Al Quwain, Ras Al Khaimah, Fujairah) for properties located therein; and (d) UAE Federal Authorities (including Ministry of Economy, TDRA, UAE Data Office, Ministry of Interior, Federal Tax Authority, Central Bank, Securities and Commodities Authority) for matters of nationwide application. |
“AI Agent” | Any artificial intelligence-powered automated system, algorithm, model, or interface, including but not limited to: voice bots, conversational chatbots, virtual assistants, automated valuation models (AVMs), predictive analytics engines, natural language processing (NLP) systems, machine learning models, deep learning networks, generative AI tools, recommendation engines, and any other AI-driven interfaces deployed by Address Point Properties to engage with Users, qualify leads, provide property information, schedule appointments, perform analytics, or deliver any service-related function, whether currently existing or developed in the future. |
“Call Recording” | The audio capture, digital storage, metadata logging, transcription, analysis, processing, and potential use of telephone conversations (voice, VoIP, video calls) between Users and Address Point Properties representatives (human agents, supervisors, AI Agents), conducted for purposes including training, quality assurance, compliance monitoring, dispute resolution, AI model improvement, legal defense, and regulatory audit, subject to the consent framework herein. |
“Website” | The primary digital platform of Address Point Properties located at www.approperties.ae, including all subdomains (e.g., api.approperties.ae, portal.approperties.ae), microsites, landing pages, mobile applications, client portals, admin interfaces, and any associated web properties, digital assets, or online platforms operated by or on behalf of the Company, whether currently existing or developed in the future. |
“Events & Competitions” | Any contest, competition, lucky draw, raffle, giveaway, promotion, seminar, talk, workshop, webinar, roadshow, dinner, exhibition, launch event, networking session, treasure hunt, quiz, challenge, or any other organized activity, whether online or offline, hosted, sponsored, organized, or promoted by Address Point Properties where participants may be eligible for prizes, recognition, or other benefits. |
“UAE”, “Emirates” | The United Arab Emirates, a federal state comprising seven Emirates: Abu Dhabi, Dubai, Sharjah, Ajman, Umm Al Quwain, Ras Al Khaimah, and Fujairah. References to UAE law include Federal laws applicable nationwide and Emirate-specific laws applicable within respective territorial jurisdictions. |
“Force Majeure” | Any event or circumstance beyond the reasonable control of a party, including but not limited to: acts of God, war, terrorism, civil unrest, labor disputes, government actions, epidemics, pandemics, fire, flood, earthquake, utility failures, telecommunications disruptions, cyberattacks, supply chain interruptions, or any other event that could not have been reasonably prevented, avoided, or overcome. |
1.3.1 Rules of Interpretation: Unless otherwise specified:
- Headings and subheadings are for convenience only and do not affect interpretation or limit the scope of any provision;
- References to “including”, “including but not limited to”, “such as”, or “for example” shall be construed as illustrative and not exhaustive, and shall not limit the general principle or category to which they refer;
- References to statutory provisions, regulations, or guidelines include any amendments, re-enactments, replacements, consolidations, or subordinate legislation issued thereunder;
- The singular includes the plural and vice versa; gender-neutral language applies to all genders and legal persons;
- References to “writing” or “written” include electronic communications, digital signatures, and any form of record that is accessible and reproducible for subsequent reference;
- References to “days” mean calendar days unless expressly specified as business days;
- References to “UAE law” or “applicable law” include Federal laws, Emirate-specific laws, regulatory guidelines, judicial precedents, and recognized legal principles of the UAE;
- Any obligation not to do something includes an obligation not to allow or permit that thing to be done by any third party under the party’s control or direction.
1.4 Jurisdiction, Governing Law, Dispute Resolution and Risk Allocation
1.4.1 Governing Law: These Terms and any non-contractual obligations arising out of or in connection with your use of our services shall be governed by, construed, and interpreted in accordance with the Federal Laws of the United Arab Emirates, without regard to its conflict of law principles. Where Federal law is silent or permits Emirate-specific regulation, the laws and regulations of the Emirate of Abu Dhabi shall apply as the Company’s headquarters jurisdiction.
1.4.2 Primary Jurisdiction and Venue: Subject to mandatory provisions of UAE Federal law that cannot be derogated by contract:
- The courts of the Emirate of Abu Dhabi shall have exclusive jurisdiction and venue over any dispute, claim, or controversy arising out of or relating to these Terms, our services, or your interactions with Address Point Properties, unless otherwise required by mandatory Federal law;
- For matters specifically relating to properties located in Emirates other than Abu Dhabi, the parties acknowledge that Relevant Authorities of the property’s location Emirate may have regulatory oversight, but contractual disputes shall remain subject to Abu Dhabi courts unless Federal law mandates otherwise;
- You hereby irrevocably submit to the personal jurisdiction of Abu Dhabi courts and waive any objection to venue or forum non conveniens.
1.4.3 Comprehensive Dispute Resolution Mechanism: Any dispute, controversy, or claim arising out of or relating to these Terms shall be resolved exclusively through the following mandatory, sequential process:
- Good Faith Negotiation (Mandatory First Step): The parties shall engage in good faith negotiation for a period of thirty (30) days or less or more as determined by Address Point Properties on a case by case basis, from written notice of dispute. All communications during this period shall be without prejudice and inadmissible in subsequent proceedings.
- Mediation (If Negotiation Fails): If unresolved after negotiation, parties agree to attempt mediation through:
- The Abu Dhabi Commercial Conciliation and Arbitration Centre (ADCCAC); OR
- A mutually agreed, UAE-qualified mediator; OR
- Such other mediation institution as may be designated by Abu Dhabi courts.
Mediation shall be conducted in Abu Dhabi, in English or Arabic as agreed, with costs shared equally unless otherwise determined by the mediator.
- Binding Arbitration or Litigation (Final Step): If mediation fails within sixty (60) days of initiation or more or less as determined by Address Point Properties on a case by case basis, disputes shall be submitted to:
- Option A (Company Election): Binding arbitration under the rules of the Abu Dhabi Commercial Conciliation and Arbitration Centre (ADCCAC), with a sole arbitrator appointed by ADCCAC, seated in Abu Dhabi, conducted in English, with award enforceable in UAE courts; OR
- Option B (User Election, if permitted by law): The competent courts of Abu Dhabi, UAE.
The Company reserves the right to elect Option A or B at its sole discretion, subject to mandatory provisions of UAE law.
1.4.4 Class Action, Collective Redress and Jury Waiver: To the maximum extent permitted by UAE law:
- You agree that any dispute shall be resolved on an individual basis only;
- You hereby irrevocably waive any right to participate in class actions, class arbitrations, collective actions, representative proceedings, or any form of collective redress against Address Point Properties;
- You acknowledge that UAE law does not provide for jury trials in civil commercial matters, and you waive any claim to trial by jury to the extent such concept could theoretically apply.
1.4.5 Limitation Periods: Any claim or cause of action arising out of or relating to these Terms or our services must be commenced within twelve (12) months from the date the claim accrued, or such shorter period as may be prescribed by mandatory UAE law. Failure to commence proceedings within this period shall constitute an absolute and perpetual bar to such claim.
1.4.6 Prevailing Party Costs: In any dispute resolution proceeding, the prevailing party shall be entitled to recover its reasonable legal fees, costs, and expenses from the non-prevailing party, including but not limited to: attorney fees, expert witness fees, court costs, arbitration fees, translation costs, and enforcement costs.

ABSOLUTELY NO DECISION regarding property purchase, sale, lease, investment, financing, development, joint venture, or any real estate transaction, commitment, or obligation should be made, entered into, or relied upon based solely or primarily on Website content, AI-generated outputs, third-party sourced information, preliminary communications, or any interaction with Address Point Properties that has not culminated in a formal, executed written agreement. You expressly, knowingly, irrevocably, and unconditionally agree and covenant to:
- Consult Directly: Consult directly with an authorized, licensed, and qualified representative of Address Point Properties to verify all material facts, obtain current and accurate information, receive personalized guidance, understand all risks, costs, obligations, regulatory requirements, and alternatives, and confirm the status and terms of any potential transaction;
- Conduct Independent Due Diligence: Conduct comprehensive, independent due diligence at your own expense, including but not limited to: title verification via DMT/DLD official portals; developer reputation, financial health, and delivery track record assessment; community regulations, service charges, and master association rules review; financial feasibility, cash flow, and ROI analysis with qualified advisors; legal review of all transaction documents by UAE-qualified counsel; physical inspection of properties where feasible; and verification of all representations and warranties;
- Review and Execute Formal Agreements: Review, negotiate if desired, and execute formal written agreements that accurately, completely, and exclusively reflect the terms of any transaction, with opportunity for independent legal review prior to signing, and that expressly incorporate these Terms by reference;
- Assume All Risks: Assume all risks, responsibilities, and consequences associated with your decisions, actions, and transactions, including market risks, regulatory risks, counterparty risks, construction risks, and any other risks inherent in real estate investment and transactions.
Address Point Properties shall not be liable, responsible, or accountable in any manner for any loss, damage, harm, cost, expense, or adverse consequence of any kind resulting from your failure to comply with this mandatory consultation, due diligence, and verification requirement. Your failure to comply constitutes a material breach of these Terms and a waiver of any claim against the Company.
3ABU DHABI HEADQUARTERS, UAE-WIDE SERVICE AUTHORIZATION AND REGULATORY COMPLIANCE
3.1 Company Domicile, Licensing and Primary Regulatory Oversight
3.1.1 Abu Dhabi Headquarters: Address Point Properties is headquartered, incorporated, and primarily licensed in the Emirate of Abu Dhabi, United Arab Emirates. The Company’s registered office, principal place of business, management, and operational control are located in Abu Dhabi, and the Company is subject to the primary regulatory oversight of the Abu Dhabi Department of Municipalities and Transport (DMT) for its real estate brokerage activities.
3.1.2 UAE-Wide Service Authorization: Pursuant to UAE Federal law, inter-emirate cooperation frameworks, and applicable regulatory provisions, Address Point Properties is authorized to provide real estate brokerage, marketing, advisory, and transaction facilitation services for properties located in any of the seven Emirates of the UAE (Abu Dhabi, Dubai, Sharjah, Ajman, Umm Al Quwain, Ras Al Khaimah, and Fujairah), subject to compliance with the local regulatory requirements of the Emirate where each specific property is situated.
3.1.3 Dual Compliance Framework: When marketing or brokering properties located in Emirates other than Abu Dhabi, Address Point Properties shall comply with:
- The regulatory requirements of the Emirate where the property is located (e.g., DLD/RERA for Dubai properties) for property-specific marketing, permitting, and transaction registration;
- The regulatory requirements of Abu Dhabi (DMT) as the Company’s primary jurisdiction for brokerage licensing, corporate governance, and overall compliance oversight;
- All applicable UAE Federal laws of nationwide application (PDPL, telemarketing regulations, cybercrime law, commercial law, etc.).
This dual compliance framework ensures comprehensive regulatory adherence while maintaining Abu Dhabi as the Company’s legal and operational home.
3.1.4 Regulatory Disclosures: All marketing materials, communications, and disclosures shall clearly and conspicuously identify:
- That Address Point Properties is an Abu Dhabi-headquartered entity licensed by Abu Dhabi DMT;
- The Emirate in which each specific property is located;
- The Relevant Authority governing the transaction for that property (DMT for Abu Dhabi properties; DLD/RERA for Dubai properties; respective authorities for other Emirates);
- The Company’s Abu Dhabi brokerage license number and any property-specific marketing permit numbers as required by local regulations;
- Appropriate disclaimers regarding information accuracy, subject to change, and verification requirements.
3.2 Inter-Emirate Operations, Data Flows and Jurisdictional Coordination
3.2.1 Cross-Emirate Service Delivery: To provide seamless, UAE-wide service, Address Point Properties may:
- Market Abu Dhabi properties to clients residing in Dubai or other Emirates, and vice versa;
- Coordinate viewings, negotiations, and transactions across Emirate boundaries;
- Share client information and transaction details between Abu Dhabi headquarters and satellite offices, representatives, or partners in other Emirates;
- Comply with local regulatory requirements for property marketing in each Emirate while maintaining centralized compliance oversight from Abu Dhabi.
3.2.2 Data Transfers Between Emirates: Personal Data may be transferred between Address Point Properties’ Abu Dhabi headquarters and representatives, offices, or systems located in other Emirates for the purposes of service delivery, lead management, transaction facilitation, and regulatory compliance. Such transfers are conducted under:
- Binding internal data protection policies aligned with UAE PDPL and Emirate-specific requirements;
- Role-based access controls, encryption for data in transit and at rest, and comprehensive audit logging;
- Staff training on data handling, confidentiality, and cross-emirate transfer protocols;
- Regular security assessments and compliance audits.
3.2.3 Jurisdictional Coordination for Disputes: In the event of a dispute involving a property located in an Emirate other than Abu Dhabi:
- Regulatory complaints regarding property marketing or transaction conduct may be filed with the Relevant Authority of the property’s location Emirate;
- Contractual disputes, data protection complaints, and general legal claims shall remain subject to the governing law and exclusive jurisdiction of Abu Dhabi courts as specified in Section 1.4;

4EXHAUSTIVE EXPRESSION OF INTEREST FRAMEWORK, CONSENT MECHANISMS AND TELEMARKETING COMPLIANCE
4.1 Binding Acceptance Mechanisms: Comprehensive and Irrevocable
By any one or more of the following actions, you expressly, knowingly, voluntarily, irrevocably, and unconditionally acknowledge and agree to be legally bound by these Terms in their entirety, including all amendments, exhibits, incorporated documents, and future modifications:
- Accessing, browsing, scrolling, clicking, hovering, viewing, downloading, or otherwise interacting with the Address Point Properties Website (www.approperties.ae) or any digital platform, mobile application, client portal, API, or web property operated by or on behalf of the Company, regardless of duration, depth, or purpose of interaction;
- Submitting any online form, contact request, property inquiry, registration, application, callback request, newsletter signup, downloadable resource request, account creation, event registration, contest entry, or any other data entry mechanism on our digital platforms, whether completed, partially completed, or abandoned;
- Responding positively to any Marketing Communication from Address Point Properties, including but not limited to: clicking a link, replying to a message, liking, sharing, commenting, saving, following, subscribing, or otherwise engaging with content on any social media platform (Meta, Google, TikTok, LinkedIn, X, Snapchat, Pinterest, etc.) or legacy media channel (print, radio, TV, outdoor, direct mail);
- Providing your name, phone number (mobile or landline), email address, Emirates ID, passport number, physical address, or other contact, identification, or demographic details to Address Point Properties via any channel, including but not limited to: in-person signups at events, exhibitions, offices, sales centers, or property viewings; telephone conversations (inbound or outbound); QR code scans; business card exchanges; voice messages; email correspondence; contest or event registration forms; or through authorized third-party partners, referral networks, affiliate marketers, co-brokers, or lead generation platforms;
- Engaging with any AI Agent, chatbot, voice bot, automated system, interactive tool, or algorithmic interface deployed by Address Point Properties for lead qualification, information provision, appointment scheduling, property matching, valuation estimates, investment analysis, or any other service-related function;
- Registering for, attending, participating in, or engaging with any webinar, virtual event, physical exhibition, property launch, investor seminar, educational workshop, networking session, contest, competition, lucky draw, or other gathering organized, hosted, sponsored, or promoted by Address Point Properties;
- Downloading, installing, accessing, registering for, or using any mobile application, client portal, software tool, or digital platform provided by or associated with Address Point Properties;
- Allowing the collection of technical data (IP address, device identifiers, browser information, location data, browsing behavior) via cookies, pixels, SDKs, server logs, or similar tracking technologies on our digital platforms, where such data is linked or linkable to your identity, contact information, or device;
- Being referred to Address Point Properties by a third party (developer, partner broker, affiliate, friend, family member, colleague) where your contact details are shared with us with your knowledge, implied consent, or where you subsequently engage with our services;
- Continuing to access, use, or interact with our services after any amendment, update, modification, or restatement of these Terms has been posted on the Website, communicated via email/SMS/WhatsApp, or otherwise made available to you through any channel.
Electronic Acceptance and Signature: You acknowledge that your electronic actions (clicks, form submissions, engagements, digital signatures) constitute legally binding signatures and manifestations of assent under UAE Federal Law No. 1 of 2006 on Electronic Commerce and Transactions, and shall have the same force and effect as handwritten signatures on paper documents.

4.2.1 Exhaustive Definition of Expression of Interest: An Expression of Interest includes, without limitation, any action that demonstrates intent, inquiry, engagement, or interest regarding real estate offerings, services, information, or opportunities from Address Point Properties, specifically:
- Digital Platform Interactions: Visiting, browsing, scrolling, hovering, clicking, viewing, downloading, or otherwise interacting with the Address Point Properties Website, mobile application, client portal, or any digital platform operated by the Company, regardless of whether a form is submitted, contact details are provided, or a transaction is initiated;
- Form Submissions and Data Entry: Submitting, partially completing, or abandoning any website form, contact request, property inquiry, registration, application, callback request, newsletter subscription, downloadable resource request, account creation, event registration, contest entry, or any other data entry mechanism on our digital platforms;
- Marketing Engagement and Response: Responding positively to any Marketing Communication, including but not limited to: clicking a link in an email or ad, replying to an SMS/WhatsApp message, opening a marketing email (tracked via pixel or similar technology), engaging with a social media post/reel/story/video/ad (like, comment, share, save, click, follow), interacting with programmatic display advertising, responding to retargeting campaigns, or engaging with any other promotional content;
- Direct Contact Provision: Providing your name, phone number (mobile or landline), email address, Emirates ID number, passport number, physical address, or other contact, identification, or demographic details to Address Point Properties via any channel, including: in-person signups at events, exhibitions, offices, or sales centers; telephone conversations (inbound or outbound); QR code scans; business card exchanges; voice messages; email correspondence; contest or event registration; or through authorized third-party partners, referral networks, affiliate marketers, or co-brokers;
- AI Agent and Automated System Engagement: Initiating, continuing, completing, or interacting with any AI Agent, chatbot, voice bot, automated valuation model, predictive analytics tool, recommendation engine, or other AI-driven or algorithmic interface deployed by Address Point Properties for lead qualification, information provision, appointment scheduling, property matching, or service delivery;
- Event and Gathering Participation: Registering for, attending, participating in, or engaging with any webinar, virtual event, physical exhibition, property launch, investor seminar, educational workshop, networking session, contest, competition, lucky draw, or other gathering organized, hosted, sponsored, or promoted by Address Point Properties;
- Passive Data Collection and Tracking: Allowing the collection of technical data (IP address, device identifiers, browser information, location data, browsing behavior, interaction patterns) via cookies, pixels, SDKs, server logs, or similar tracking technologies on our digital platforms, where such data is linked or linkable to your identity, contact information, device, or inferred interests;
- Third-Party Referrals and Lead Sharing: Being referred to Address Point Properties by a third party (developer, partner broker, affiliate, friend, family member, colleague) where your contact details are shared with us with your knowledge, implied consent, or where you subsequently engage with our services following such referral;
- Implied or Constructive Interest: Any conduct, pattern of behavior, or circumstance that a reasonable person would interpret as demonstrating interest in Address Point Properties’ services, properties, or offerings, including but not limited to: repeated website visits, prolonged engagement with property listings, saving or favoriting properties, requesting comparative analyses, or inquiring about financing options.
4.2.2 Irrevocable Legal Effect and Consequences: Upon making an Expression of Interest as defined above, you expressly, knowingly, irrevocably, and unconditionally:
- Qualify for Comprehensive Follow-Up: Qualify to receive follow-up communications from Address Point Properties or its authorized representatives, including but not limited to: telephone callbacks (human or AI), emails, SMS/MMS messages, WhatsApp Business messages, social media direct messages, postal mail, in-person visits, or other contact methods, in direct response to your query, engagement, or demonstrated interest, for an indefinite period unless you validly withdraw consent as specified herein;
- Grant Comprehensive Data Processing Consent: Grant explicit, informed, unambiguous, voluntary, comprehensive, and revocable (subject to limitations) consent for Address Point Properties to collect, process, store, transfer, share, analyze, profile, and otherwise handle your Personal Data and any other information you provide or that is generated about you for the purposes of: lead qualification, property matching, service delivery, transaction facilitation, regulatory compliance, marketing communications (subject to withdrawal rights), analytics, service improvement, fraud prevention, AI training, quality assurance, and any other legitimate business purpose consistent with these Terms and applicable law;
- Acknowledge UAE-Wide Contact Authorization: Acknowledge that follow-up communications may originate from Company representatives, AI Agents, or authorized partner brokers located in Abu Dhabi (headquarters), Dubai, or any other Emirate within the UAE, and that your Expression of Interest is valid for contact regardless of the Emirate in which you reside, the property is located, or the communication originates;
- Override DNCR Restrictions via Explicit Consent: Confirm that your Expression of Interest constitutes a valid, documented, auditable, and irrevocable (until withdrawn) basis for contact under Article 6 of Cabinet Resolution No. 56 of 2024, thereby permitting Address Point Properties to contact you via telephone notwithstanding any registration of your number on the Federal Do Not Call Registry (DNCR), as your explicit consent obtained through an Expression of Interest overrides DNCR status per Article 6(5) of said Resolution, subject only to your valid withdrawal of consent as specified in Section 4.5;
- Provide Prior Consent for Call Recording: Provide prior, explicit, informed, and comprehensive consent for the recording of telephone calls made in response to your Expression of Interest, for the purposes detailed in Section 6 of these Terms (Call Recording, AI Training, and Quality Assurance), subject to the verbal notification protocol at the start of each call as required by procedural regulations;

- Waive Defenses Based on Technicalities: Waive any defense, objection, or claim based on: lack of actual knowledge of these Terms; claim of inadvertent, accidental, or unintentional engagement; assertion that your actions did not constitute a valid Expression of Interest given the exhaustive definition provided; or any other technical, procedural, or interpretive argument that would undermine the binding effect of your Expression of Interest.
4.3 Multi-Channel Marketing Consent Framework: Comprehensive and UAE-Wide
4.3.1 Scope, Breadth and Duration of Consent: By engaging with any Address Point Properties Marketing Communication or making an Expression of Interest as defined in Section 4.2, you hereby grant explicit, informed, unambiguous, voluntary, comprehensive, and revocable (subject to limitations) consent to the Company to:
- Contact you via any lawful channel, medium, or technology, including but not limited to: telephone (voice calls, VoIP, video calls), email, SMS/MMS, WhatsApp Business, social media direct messaging, postal mail, in-person visits, or any emerging communication channel, for the purposes of:
- Responding to your inquiry, Expression of Interest, or service request in a timely and comprehensive manner;
- Qualifying your lead status, understanding your property requirements, budget, timeline, preferences, risk tolerance, and investment objectives;
- Providing information about properties, developments, services, promotions, market updates, investment opportunities, or regulatory changes;
- Scheduling property viewings, consultations, follow-up meetings, site visits, virtual tours, or developer presentations;
- Conducting customer satisfaction surveys, feedback collection, net promoter score (NPS) analysis, service improvement initiatives, or market research;
- Notifying you of transaction milestones, documentation requirements, regulatory updates, or time-sensitive opportunities;
- Inviting you to events, webinars, exhibitions, property launches, investor seminars, contests, competitions, or educational sessions;
- Providing post-transaction support, relationship management, or referral opportunities.
- Share your inquiry details, contact information, preferences, behavioral data, transaction-related information, and any other Personal Data with:
- Authorized brokerage partners, co-brokers, referral networks, or affiliate marketers registered with DMT (Abu Dhabi) or other Relevant Authorities for properties in other Emirates;
- Property developers, owners, master developers, or project management teams for the specific properties you have inquired about or that match your profile;
- Service providers necessary to fulfill your request or enhance service delivery, including but not limited to: mortgage brokers, valuation firms, legal consultants, property management companies, relocation services, interior designers, and facility managers;
- Government authorities (DMT, DLD, TDRA, UAE Data Office, Ministry of Interior, Federal Tax Authority) as required for regulatory compliance, transaction registration, lawful requests, or public interest objectives;
- Technology providers, cloud infrastructure partners, analytics platforms, or AI service providers under binding data processing agreements that comply with UAE PDPL.
- Use your contact information, interaction history, preference data, behavioral patterns, and inferred interests for:
- Internal analytics, business intelligence, market research, trend analysis, and strategic planning;
- Service optimization, personalization, user experience enhancement, and product development;
- Compliance monitoring, audit trails, regulatory reporting, and risk management;
- Fraud detection, prevention, investigation, and security enhancement;
- Training and improving our human staff, AI systems, algorithms, and service delivery processes (subject to anonymization and privacy-preserving safeguards where feasible);
- Creating aggregated, anonymized, or pseudonymized datasets for research, benchmarking, or commercial licensing, provided such datasets cannot reasonably be used to re-identify you.
4.3.2 UAE-Wide and Cross-Border Application: This consent is expressly UAE-wide and applies to marketing and follow-up activities conducted by Address Point Properties’ teams operating in Abu Dhabi (headquarters), Dubai, or any other Emirate, as well as by authorized partners, affiliates, or service providers registered with the Relevant Authority for the property’s location or your residence. Where international data transfers are necessary (e.g., to global cloud providers), such transfers shall comply with Section 10.4 of these Terms.
4.3.3 Consent Granularity and Preference Management: Where technically feasible and legally required, we provide options to manage consent granularity (e.g., opt-in to email but not SMS, or opt-out of marketing while maintaining service communications). However, your Expression of Interest constitutes baseline consent for essential service-related communications necessary to respond to your inquiry, fulfill contractual obligations, or comply with legal requirements, which cannot be withdrawn without terminating the underlying service relationship.
4.4 Strict Compliance with UAE Telemarketing Regulations: DNCR, Calling Hours and Documentation
4.4.1 Cabinet Resolution No. 56 of 2024 Adherence: All telemarketing activities conducted by or on behalf of Address Point Properties shall comply strictly, demonstrably, and comprehensively with Cabinet Resolution No. 56 of 2024 concerning the Regulation of Telemarketing Activities, including but not limited to the following mandatory requirements:
- Caller ID and Number Compliance: All outbound marketing calls shall be made only using UAE-registered local telephone numbers that are associated with Address Point Properties’ valid Abu Dhabi commercial license and brokerage authorization, are identifiable to the recipient, and comply with TDRA numbering regulations;
- Calling Hours Restriction: Calls shall be placed only between the hours of 9:00 AM and 6:00 PM UAE local time (Sunday to Thursday), unless you have expressly agreed in writing to contact outside these hours for urgent, time-sensitive transaction-related matters that cannot reasonably be deferred;
- DNCR Screening Protocol: Prior to initiating any telemarketing call, Address Point Properties shall screen the target telephone number against the Federal Do Not Call Registry (DNCR) maintained by the Telecommunications and Digital Government Regulatory Authority (TDRA) via approved API integration, manual verification, or other compliant methods;
- DNCR Exemption via Explicit Consent: Where a User has made an Expression of Interest as defined in Section 4.2, such consent constitutes a valid, documented, auditable, and irrevocable (until withdrawn) exemption from DNCR restrictions per Article 6(5) of Cabinet Resolution No. 56 of 2024, permitting Address Point Properties to contact the User notwithstanding DNCR registration, provided that:
- The consent is specific to the nature of the inquiry, property type, or service interest expressed;
- The contact is directly responsive to that inquiry, interest, or a reasonably related follow-up;
- The User retains the right to withdraw consent at any time via mechanisms described in Section 4.5, subject to the limitations therein.

- Verify the provenance, consent status, and freshness of acquired leads before initiating contact, including DNCR screening and consent validation;
- Maintain records of the third-party source, consent documentation, and data transfer agreements for audit and compliance purposes;
- Immediately cease contact, delete data, and investigate if consent validity is questioned, withdrawn, or if the third party is found non-compliant;
- Reserve the right to audit third-party partners’ consent practices and to terminate relationships for non-compliance.
4.5 Right to Withdraw Consent: Mechanisms, Limitations and Irrevocable Consequences
4.5.1 Withdrawal Methods and Procedures: You retain the right to withdraw your consent to receive Marketing Communications or telemarketing calls at any time, through any of the following convenient methods:
- Electronic Unsubscribe: Clicking the “unsubscribe”, “manage preferences”, or “opt-out” link included in the footer of any electronic communication (email, SMS, WhatsApp) from Address Point Properties;
- Keyword Reply: Replying “STOP”, “UNSUBSCRIBE”, “OPT-OUT”, or similar keyword to any SMS or WhatsApp message from the Company, where mentioned in the message or campaign outreach itself;
- Direct Written Request: Submitting a written, signed request via email to privacy@approperties.ae or via postal mail to our Abu Dhabi registered office address, clearly stating your request to withdraw consent for marketing communications, with identity verification as required;
- Telephone Request: Informing any Address Point Properties human representative during a telephone conversation that you wish to withdraw consent for future marketing communications, which shall be documented and actioned;
- DNCR Registration: Registering your telephone number on the Federal Do Not Call Registry (DNCR) via the TDRA portal (https://www.tdra.gov.ae), which will restrict unsolicited telemarketing calls from entities that rely solely on legitimate interest rather than explicit consent (note: your prior Expression of Interest may still permit contact until consent is directly withdrawn from us).
4.5.2 Processing Timeline, Confirmation and Effective Date: Withdrawal of consent shall be processed and implemented within five (5) business days of receipt of a valid, verifiable request. - Prevent communications required for compliance with a legal obligation under UAE law (e.g., regulatory reporting, audit responses, lawful authority requests, AML/CFT obligations);
- Obligate Address Point Properties to delete Personal Data that must be retained for legal, regulatory, legitimate business, or risk management purposes (e.g., transaction records, fraud prevention logs, consent audit trails, dispute documentation);
- Prevent the Company from maintaining minimal “suppression list” information (e.g., your email or phone number marked as “do not contact for marketing”) to ensure your withdrawal request is respected in future communications, which is necessary for compliance and cannot be deleted without undermining the withdrawal;
- Entitle you to any refund, compensation, damages, or other remedy for communications sent prior to the effective date of withdrawal;
- Affect your obligations under these Terms, including indemnification, limitation of liability, or dispute resolution provisions, which survive termination or withdrawal.
4.5.4 Re-Opt-In and Consent Renewal: If you withdraw consent but later wish to receive marketing communications again, you may re-opt-in by:
- Submitting a new inquiry or Expression of Interest via our Website or other channels, which will constitute a new consent event;
- Explicitly requesting to be re-subscribed via email, telephone, or in-person, with documented confirmation;
- Updating your preferences through your client portal account (if applicable), with explicit confirmation.
4.5.5 Irrevocable Acknowledgment of Consequences: You expressly acknowledge and agree that withdrawal of consent may limit or terminate our ability to provide certain services, respond to inquiries, or maintain your client relationship, and that Address Point Properties shall not be liable for any adverse consequences resulting from your decision to withdraw consent, including missed opportunities, delayed responses, or service limitations.
5EVENTS, CONTESTS, COMPETITIONS, PROMOTIONS AND LUCKY DRAWS

5.1 Scope of Events and Competitions
Address Point Properties may, from time to time, host, organize, sponsor, or promote various events, activities, and promotional initiatives including but not limited to:
- Contests & Competitions: Quizzes, challenges, treasure hunts, photo contests, video competitions, essay contests, design competitions, and any skill-based or chance-based competitions;
- Lucky Draws & Raffles: Random prize draws, raffles, giveaways, sweepstakes, and any chance-based promotional activities;
- Events & Gatherings: Seminars, talks, workshops, webinars, roadshows, dinners, networking sessions, property launches, investor briefings, exhibitions, and open houses;
- Promotions & Offers: Special offers, referral programs, loyalty programs, early-bird incentives, and any other promotional initiatives;
- Online & Offline Activities: Any combination of digital, physical, or hybrid activities conducted via website, social media, mobile applications, physical venues, or any other channel.
Collectively referred to as “Events & Competitions” throughout these Terms.
5.2 Participation Requirements and Data Collection
Participation in Events & Competitions may require you to:
- Submit personal and contact information including but not limited to: full name, email address, phone number, Emirates ID number, passport number, physical address, date of birth, nationality, residency status, and any other information specified in the Event & Competition rules;
- Complete specific tasks, challenges, or requirements as outlined in the Event & Competition rules;
- Agree to additional terms and conditions specific to the particular Event & Competition;
- Provide consent for photography, videography, or recording at physical events for promotional purposes;
- Allow Address Point Properties to verify your identity, eligibility, and compliance with Event & Competition rules.
Information may be collected online via website forms, social media platforms, mobile applications, or offline at event venues, sales centers, exhibitions, or through authorized third-party partners.
5.3 Marketing Database Inclusion and Consent
BY PARTICIPATING IN ANY EVENT OR COMPETITION, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:
- Your personal and contact information submitted for participation shall be added to Address Point Properties’ marketing database;
- You grant explicit, informed, unambiguous, voluntary, and comprehensive consent to receive marketing communications from Address Point Properties, including but not limited to: telephone calls, emails, SMS/MMS messages, WhatsApp Business messages, social media communications, postal mail, and invitations to future events;
- This consent constitutes a valid Expression of Interest under Section 4 of these Terms and overrides Do Not Call Registry (DNCR) restrictions per Article 6(5) of Cabinet Resolution No. 56 of 2024;
- Your consent for marketing communications shall remain valid for a period of seven (7) years from the date of participation, unless you validly withdraw consent as specified in Section 4.5;
- Your data may be used for lead qualification, property matching, service delivery, analytics, service improvement, and any other legitimate business purpose consistent with these Terms and the Privacy Policy;
- This marketing consent is separate from and in addition to any consent required for Event & Competition administration, and withdrawal of marketing consent does not affect your eligibility for prizes already awarded.
5.4 No Guarantee of Victory, Success or Prize
CRITICAL DISCLAIMER – PLEASE READ CAREFULLY:
- Participation Does Not Guarantee Victory: Participation in any Event or Competition does not guarantee, imply, or suggest any likelihood of victory, success, winning, or receiving any prize, reward, benefit, or recognition whatsoever;
- No Prize Promised by Participation Alone: No prize, reward, benefit, or compensation is promised, guaranteed, or assured to any participant by virtue of participation alone. Prizes are awarded solely at the discretion of Address Point Properties based on the specific rules of each Event or Competition;
- Multiple Participants May Meet Criteria: Address Point Properties acknowledges that multiple participants may meet the stated criteria for victory (e.g., getting all the right answers in a quiz, completing all the right tasks in a contest, finding all the right clues in a treasure hunt, meeting all eligibility requirements, etc.). The mere fact of meeting criteria does not automatically entitle any participant to a prize;
- Sole Discretion on Winner Determination: It is totally, completely, exclusively, and absolutely within the sole and absolute discretion of Address Point Properties management to determine:
- Who wins or ties for victory in any Event or Competition;
- Whether prizes will be split between tying victors or awarded to a single winner;
- Whether prizes will be awarded on a first-come-first-served basis, to the participant who submitted all correct answers first, to the participant with the highest score, or through any other method;
- Whether prizes will be awarded completely randomly (e.g., lucky draw) regardless of performance or criteria met;
- Whether any prize will be awarded at all, regardless of participation levels or criteria met;
- Whether an Event or Competition will be cancelled, modified, suspended, or terminated at any time without prior notice.
- Unlimited Time for Winner Determination: Address Point Properties may take however long it wants, deems necessary, or considers appropriate in determining the victor of any contest, competition, lucky draw, or Event. There is no guaranteed timeline for winner announcement, prize distribution, or Event conclusion. Address Point Properties reserves the right to extend, delay, or postpone winner determination indefinitely without liability or obligation to participants;
- Management Decision is Final: All decisions made by Address Point Properties management regarding Events & Competitions, including but not limited to winner selection, prize allocation, rule interpretation, eligibility determination, and disqualification, shall be final, binding, conclusive, and not subject to appeal, challenge, review, or dispute by any participant or third party.
5.5 Prize Terms and Conditions
5.5.1 Prize Description and Substitution:
- Prizes described in Event & Competition materials are approximate and may vary from descriptions, images, or representations;
- Address Point Properties reserves the right to substitute any prize with another prize of equal or greater value without prior notice to participants;
- Prizes are non-transferable, non-exchangeable, and non-convertible to cash unless expressly stated otherwise;
- Prizes may be subject to additional terms, conditions, restrictions, or expiration dates imposed by prize suppliers or manufacturers.
5.5.2 Prize Collection and Forfeiture:
- Winners are responsible for collecting prizes within the timeframe specified by Address Point Properties;
- Failure to claim a prize within the specified timeframe shall result in automatic forfeiture of the prize without compensation or alternative award;
- Address Point Properties may require winners to provide proof of identity, eligibility, and compliance with Event & Competition rules before prize distribution;
- Prizes may be withheld or forfeited if winners fail to comply with any terms, conditions, or verification requirements.
5.5.3 Taxes and Additional Costs:
- Winners are solely responsible for any taxes, duties, fees, levies, or other charges imposed by UAE Federal or Emirate-specific authorities on prizes awarded;
- Address Point Properties shall not be responsible for any additional costs associated with prize collection, delivery, installation, maintenance, or use;
- Winners may be required to provide tax documentation or identification numbers before prize distribution.
5.6 Eligibility Requirements and Disqualification
5.6.1 Eligibility Criteria:
- Events & Competitions may be restricted to UAE residents, specific Emirates, age groups, or other eligibility criteria as specified in Event-specific rules;
- Employees, directors, officers, agents, and immediate family members of Address Point Properties, its affiliates, partners, sponsors, or suppliers may be excluded from participation;
- Participants must meet all eligibility requirements specified for each Event & Competition; failure to meet requirements shall result in disqualification;
- Address Point Properties reserves the right to verify eligibility at any time before, during, or after an Event & Competition.
5.6.2 Grounds for Disqualification:
- Providing false, inaccurate, incomplete, or misleading information;
- Attempting to manipulate, cheat, defraud, or game the Event & Competition through any means including automated systems, bots, multiple entries, fake identities, or any other improper method;
- Violating any Event & Competition rules, these Terms, or applicable UAE laws;
- Engaging in conduct that is fraudulent, abusive, harassing, threatening, defamatory, or otherwise objectionable;
- Being previously disqualified from any Address Point Properties Event & Competition;
- Failure to comply with verification requests or prize collection requirements.
Disqualified participants shall not be entitled to any prize, compensation, refund, or remedy of any kind.
5.7 Limitation of Liability for Events & Competitions
TO THE MAXIMUM EXTENT PERMITTED BY UAE LAW:
- Address Point Properties shall not be liable for any technical failures, network interruptions, system errors, or other issues that may affect participation in online Events & Competitions;
- Address Point Properties shall not be liable for any injury, loss, damage, or harm arising from participation in physical Events, including but not limited to: personal injury, property damage, travel accidents, or any other incident occurring before, during, or after the Event;
- Address Point Properties shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from participation in Events & Competitions;
- Address Point Properties shall not be liable for any disappointment, emotional distress, reputational harm, or other non-economic losses resulting from non-selection, disqualification, or non-award of prizes;
- Participation in Events & Competitions is entirely at your own risk.
5.8 Modification, Suspension and Cancellation
Address Point Properties reserves the absolute right, at its sole discretion and without prior notice or liability, to:
- Modify, amend, or update Event & Competition rules, terms, or requirements at any time;
- Suspend, postpone, or delay any Event or Competition for any reason;
- Cancel any Event or Competition entirely, with or without cause;
- Extend or shorten participation periods, winner determination timelines, or prize collection deadlines;
- Disqualify any participant or winner for violation of rules or these Terms;
- Withhold or revoke prizes from any participant or winner for any reason deemed appropriate by management.
Participants shall have no claim, right, or entitlement to compensation, damages, or remedies arising from any modification, suspension, or cancellation.
5.9 Publicity and Media Rights
By participating in Events & Competitions, you grant Address Point Properties the right to:
- Use your name, likeness, image, voice, photograph, video, biographical information, and any other personal attributes for promotional, advertising, marketing, or publicity purposes without compensation;
- Publish winner names, photographs, and testimonials on website, social media, marketing materials, or other channels;
- Record, photograph, or video participants at physical events for promotional purposes;
- Edit, modify, or adapt any content featuring participants as deemed appropriate.
If you do not wish to grant these rights, you should not participate in Events & Competitions.
5.10 Additional Protective Clauses for Company Interests
5.10.1 Force Majeure for Events: Address Point Properties shall not be liable for any failure to conduct, complete, or award prizes for Events & Competitions due to Force Majeure events including but not limited to: government restrictions, venue unavailability, supplier failures, natural disasters, epidemics, or any other circumstance beyond reasonable control.
5.10.2 Fraud Prevention: Address Point Properties reserves the right to investigate any suspected fraud, manipulation, or abuse related to Events & Competitions. Participants must cooperate fully with any investigation. Failure to cooperate may result in disqualification and legal action.
5.10.3 Legal Compliance: All Events & Competitions are subject to applicable UAE Federal and Emirate-specific laws, regulations, and licensing requirements. Address Point Properties reserves the right to modify or cancel Events & Competitions to ensure compliance with any legal or regulatory changes.
5.10.4 No Partnership or Employment: Participation in Events & Competitions does not create any partnership, joint venture, employment, agency, or other legal relationship between participants and Address Point Properties.
5.10.5 Indemnification for Event Participation: You agree to indemnify, defend, and hold harmless Address Point Properties from any claims, losses, damages, or expenses arising from your participation in Events & Competitions, including but not limited to: injury, property damage, rule violations, intellectual property infringement, or misconduct.
6CALL RECORDING, AI ENGAGEMENT, QUALITY ASSURANCE AND DATA PROCESSING
⚠️ CRITICAL NOTICE: CALL RECORDING AND AI PROCESSING CONSENT
6.1 Prior Consent via Marketing Interaction and Expression of Interest
By responding to any Address Point Properties Marketing Communication, making an Expression of Interest as defined in Section 4.2, participating in any Event or Competition, or otherwise engaging with the Company via telephone, voice-enabled channels, or AI interfaces, you hereby provide explicit, informed, unambiguous, voluntary, and prior consent to the following comprehensive data processing activities:
(a) Call Recording Authorization:
- Telephone calls between you and Address Point Properties representatives (human agents, supervisors, or AI Agents) may be recorded in their entirety, including voice audio, call metadata (timestamp, duration, caller ID), and any DTMF inputs (keypad entries);
- Recordings shall be used solely for the following legitimate, specified, and documented purposes:
- Internal Training & Development: To train, evaluate, coach, and improve the performance, knowledge, communication skills, and compliance adherence of our customer service, sales, support, and management staff;
- Lead Qualification & CRM Enrichment: To accurately capture, transcribe, and analyze your requirements, preferences, objections, feedback, and decision criteria for the purpose of matching you with suitable properties, personalizing service delivery, and enriching your profile in our Customer Relationship Management (CRM) system;
- Artificial Intelligence Training & Model Improvement: To train, refine, fine-tune, evaluate, and enhance the Company’s AI systems, including but not limited to: voice recognition engines, speech-to-text models, natural language processing (NLP) algorithms, conversational AI agents, sentiment analysis tools, predictive lead scoring models, and automated response generators, with the objective of handling future inquiries more effectively, accurately, efficiently, and empathetically;
- Quality Assurance & Compliance Monitoring: To monitor service quality, ensure adherence to internal policies, regulatory requirements, and ethical standards, identify training needs, resolve customer complaints, and maintain audit trails for internal and external compliance reviews;
- Dispute Resolution & Legal Defense: To maintain an accurate, tamper-evident record of conversations that may serve as evidence in the event of disputes, misunderstandings, contractual disagreements, regulatory investigations, or legal proceedings;
- Regulatory Compliance & Audit: To fulfill record-keeping, reporting, and inspection obligations imposed by Dubai Land Department, Abu Dhabi DMT, TDRA, UAE Data Office, or other Relevant Authorities under UAE real estate, telemarketing, and data protection regulations.
- Recordings shall be stored on secure, encrypted, access-controlled servers located within the United Arab Emirates, in strict compliance with UAE PDPL data localization principles, sector-specific regulations, and industry best practices for data security;
- Access to recordings shall be strictly limited to authorized personnel with a legitimate, documented, and role-based need-to-know for the purposes stated above, including: trained quality assurance analysts, compliance officers, legal counsel, authorized AI training specialists, and senior management for audit purposes;
- Recordings shall be retained for a period of twenty-four (24) months from the date of the call, unless a longer retention period is expressly required by law, regulatory obligation, legitimate legal claim, or ongoing dispute, after which they shall be securely deleted, irreversibly anonymized, or aggregated in accordance with UAE Data Office standards and our Data Retention Policy.
(b) AI Agent Engagement and Processing:
- You acknowledge that Address Point Properties may deploy AI Agents (automated voice bots, conversational chatbots, virtual assistants, or other AI-driven interfaces) to engage with you for purposes including but not limited to: initial inquiry triage, property information provision, appointment scheduling, lead qualification, FAQ responses, or post-interaction follow-up;
- Interactions with AI Agents, including voice recordings, chat transcripts, user inputs, and system responses, may be recorded, logged, analyzed, and used to:
- Improve AI model performance, accuracy, and contextual understanding;
- Identify common user queries, pain points, or service gaps;
- Train human agents on handling complex or nuanced interactions;
- Ensure AI systems operate within ethical, legal, and brand guidelines.
- You have the unconditional right to request transfer to a human representative at any point during an interaction with an AI Agent, and Address Point Properties shall facilitate such transfer promptly and seamlessly where operationally feasible, without penalty or diminution of service quality;
- AI systems used for profiling, scoring, or automated decision-making shall incorporate human oversight, explainability features, and appeal mechanisms as required by UAE AI regulations and PDPL safeguards.
(c) Verbal Notification Protocol (Procedural Compliance):
- To comply with the procedural requirement under Article 4(7) of Cabinet Resolution No. 56 of 2024 to inform the Consumer of recording “when the call begins”, and to support compliance with Federal Decree-Law No. 34 of 2021 on Cybercrimes regarding consent for recording private communications, Address Point Properties shall provide a clear, concise verbal notification at the commencement of any call that may be recorded, which can be exactly as below or a modified version thereof which communicates the same thing but in different words:
“For training, quality assurance, and service improvement purposes, this call may be recorded as consented to in our Terms. By continuing this conversation, you confirm your consent to such recording.”
- Your decision to continue the conversation after hearing this notification constitutes reaffirmation, confirmation, and ratification of the prior consent you provided via your Expression of Interest;
- If you do not consent to recording, you may politely decline to continue the call, request communication via an alternative non-recorded channel (e.g., email), or ask to speak with a supervisor regarding your concerns;
- For AI-initiated calls or interactions, the notification may be delivered via pre-recorded voice message or text display, with equivalent effect.
(d) AI Training Data Specifics and Irreversibility Acknowledgment:
- You expressly acknowledge that Personal Data contained in call recordings and AI interactions may be used to train, fine-tune, or improve machine learning models and AI systems;
- Such training may involve techniques including but not limited to: supervised learning, reinforcement learning from human feedback (RLHF), embedding generation, and model distillation;
- Once your data has been incorporated into an AI model’s training dataset and the model has been updated, it may be technically impossible or impractical to isolate, extract, or delete your specific data from the trained model weights, embeddings, or aggregated statistical patterns;
- However, Address Point Properties commits to:
- Implementing privacy-preserving techniques such as anonymization, pseudonymization, differential privacy, or federated learning where feasible;
- Deleting your raw Personal Data (e.g., original audio files, identifiable transcripts) upon valid request, subject to legal hold exceptions;
- Ensuring that AI models trained on your data do not memorize or regurgitate sensitive Personal Data in responses to other users;
- Conducting regular bias, fairness, and privacy impact assessments of AI systems as required by UAE AI governance frameworks.
6.2 Legal Basis for Processing Call Recordings and AI Training Data
6.2.1 UAE PDPL Lawful Bases: The processing of call recordings, AI interaction logs, and related Personal Data for the purposes outlined in Section 6.1 is based on one or more of the following lawful bases under UAE PDPL Article 6:

Our dual-consent framework (prior written/digital consent + verbal notification) satisfies this requirement.
6.2.3 AI Regulations Compliance: Use of Personal Data for AI training complies with Federal Decree-Law No. 47 of 2021 on AI Regulation, including requirements for transparency, human oversight, bias mitigation, and accountability in AI systems.
6.3 Your Rights Regarding Call Recordings and AI-Processed Data
6.3.1 PDPL Data Subject Rights: Subject to applicable legal exceptions, limitations, and the irreversibility considerations noted in Section 6.1(d), you retain the following rights under UAE PDPL Articles 13-18 regarding your Personal Data contained in call recordings and AI interaction logs:
- Right to Access (Art. 13): Request confirmation whether your Personal Data is being processed and obtain a copy in a concise, transparent, and intelligible format;
- Right to Correction (Art. 14): Request correction of inaccurate or incomplete Personal Data, including transcription errors in call recordings;
- Right to Erasure (Art. 15): Request deletion of your Personal Data where: (a) it is no longer necessary for the original purpose; (b) you withdraw consent (where consent was the basis); (c) processing was unlawful; or (d) erasure is required to comply with legal obligation. Note: This right is subject to legal retention obligations (e.g., DLD transaction records, telemarketing audit requirements, legal holds).
- Right to Restriction (Art. 16): Request restriction of processing under certain circumstances, e.g., while accuracy is verified or objection is considered;
- Right to Data Portability (Art. 17): Receive your Personal Data in a structured, commonly used, machine-readable format and transmit it to another controller, where processing is based on consent or contract and carried out by automated means;
- Right to Object (Art. 18): Object to processing based on legitimate interests, including profiling for direct marketing. If you object to direct marketing, we will cease such processing immediately.
6.3.2 Rights Specific to AI Processing:
- Right to Human Intervention: You have the right not to be subject to a decision based solely on automated processing (including AI profiling) which produces legal or similarly significant effects concerning you, unless necessary for a contract or based on explicit consent. You may request human review of any AI-generated decision affecting you.
- Right to Explanation: Where feasible, you may request a meaningful explanation of the logic, significance, and envisaged consequences of AI-driven processing that affects you.
- Right to Opt-Out of Profiling: You may opt-out of having your data used for AI-driven profiling or behavioral analytics for marketing purposes, without affecting your ability to receive essential service communications.
6.3.3 Exercising Your Rights: To exercise any of these rights, please submit a written, signed request to our Data Protection Officer at privacy@approperties.ae or via postal mail to our registered office. We may request verification of your identity to prevent unauthorized access. We shall respond within thirty (30) days as required by UAE PDPL, with possible extension for complex requests upon notice.
6.3.4 Limitations and Exceptions: Requests for erasure, restriction, or portability may be limited or denied where:
- Retention is necessary for compliance with DLD/DMT record-keeping requirements (typically 5-10 years for transaction-related records);
- Data is required for the establishment, exercise, or defense of legal claims;
- Granting the request would adversely affect the rights and freedoms of others;
- The request is manifestly unfounded or excessive;
- Technical constraints make isolation of data from aggregated AI model weights impracticable, though raw data will be deleted where possible.
FINAL ACKNOWLEDGMENT, CONSENT CONFIRMATION AND IRREVOCABLE ACCEPTANCE
BY PROCEEDING TO ACCESS, BROWSE, INTERACT WITH, USE, PARTICIPATE IN EVENTS OR COMPETITIONS, OR AVAIL YOURSELF OF ADDRESS POINT PROPERTIES’ SERVICES ANYWHERE IN THE UAE, YOU EXPRESSLY, KNOWINGLY, VOLUNTARILY, IRREVOCABLY, AND UNCONDITIONALLY ACKNOWLEDGE, CONFIRM, AND AGREE THAT:
- You have read, understood, and agreed to these Terms and Conditions in their entirety, including all exhibits, appendices, incorporated documents, and future amendments;
- You understand that making an “Expression of Interest” as exhaustively defined in Section 4.2 qualifies you to receive comprehensive follow-up communications, including telephone callbacks, from Address Point Properties or authorized representatives across the UAE;
- You understand that participation in any Event or Competition automatically adds you to our marketing database and grants consent for marketing communications as specified in Section 5.3;
- You acknowledge that participation in Events & Competitions does not guarantee victory, prizes, or success, and that winner determination is at the sole discretion of Address Point Properties management as specified in Section 5.4;
- You provide explicit, informed, unambiguous, prior, and comprehensive consent for Address Point Properties to record telephone calls for internal training, lead qualification, AI system improvement, quality assurance, regulatory compliance, and dispute resolution, subject to the verbal notification protocol at the start of each call;
- You acknowledge that you may be contacted by or interact with human representatives or AI Agents deployed by the Company, and that such interactions may be recorded, processed, and used to improve services and AI systems as described herein;
- You understand your rights regarding your Personal Data under UAE PDPL, the process to exercise them, the comprehensive limitations that may apply, and that withdrawal of consent may limit service availability;
- You agree that these Terms are governed by UAE Federal Law with Abu Dhabi as the primary jurisdiction for disputes, and that you waive rights to class actions, collective redress, and jury trials to the extent permitted by law;
- You expressly acknowledge, accept, and irrevocably agree to the Comprehensive Website Content Disclaimer, Anti-Reliance Clause, and Indemnification provision in Section 2, confirming that all content is for informational purposes only, may be AI-generated or third-party sourced, is subject to change without notice, and that you comprehensively indemnify Address Point Properties for any actions, decisions, losses, or claims arising from your reliance on such content without direct consultation and independent due diligence;
- You represent that you are at least 18 years of age or have valid guardian consent, that you have authority to provide any third-party data you submit, and that all information you provide is true, accurate, and complete;
- You accept the comprehensive limitations of liability, disclaimers, risk allocation, and “as is” service provisions as an essential, non-negotiable basis of our agreement, reflecting the pricing, risk assessment, and insurance arrangements underlying our services;
- Your electronic actions (clicks, form submissions, engagements, digital signatures, event registrations, contest entries) constitute legally binding signatures under UAE electronic transactions law and manifest your irrevocable acceptance of these Terms;
- You acknowledge that Address Point Properties is an Abu Dhabi-headquartered entity serving the entire UAE, regulated primarily by Abu Dhabi DMT, and that disputes shall be resolved in Abu Dhabi courts or arbitration as specified;
- You agree to comply with all obligations herein, including mandatory consultation, independent due diligence, and verification requirements before making any real estate decision or transaction.
IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS, YOU MUST IMMEDIATELY CEASE ALL ACCESS TO, USE OF, AND INTERACTION WITH ADDRESS POINT PROPERTIES’ SERVICES, WITHDRAW CONSENT VIA THE MECHANISMS IN SECTION 4.5, REQUEST DELETION OF YOUR DATA SUBJECT TO LEGAL RETENTION OBLIGATIONS, AND NOT PROVIDE ANY PERSONAL DATA, INQUIRIES, OR ENGAGEMENTS TO US. CONTINUED USE CONSTITUTES ACCEPTANCE OF THESE TERMS.
